Agreement Acceptance

By accessing or using the Atticus AI platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Starboard Labs LLC (“Company,” “we,” “us,” or “our”).

These Terms are supplemented by our Privacy Policy, which describes how we collect and handle your data, and our Security page, which describes the technical controls protecting your information. A Business Associate Agreement and Data Processing Agreement are available on request for customers who require them.

Service Description

Atticus is an AI-powered legal research and document analysis platform. Core capabilities include:

  • Legal AI Research Assistant: Real-time legal research with citations, case law analysis, and natural language Q&A powered by Anthropic Claude via AWS Bedrock
  • Secure Document Storage: Encrypted document storage with AI-powered search, analysis, and retrieval across your uploaded files
  • Web Search: Optional general legal research via web search (powered by Exa AI), with automated PII detection to prevent confidential information from being transmitted

The Service is available to users in the United States. All data is processed and stored in AWS US-East-1 (N. Virginia) data centers.

Eligibility

  • You must be 18 years or older to use the Service
  • Atticus is designed for legal professionals but is available to anyone meeting the eligibility requirements
  • You must provide accurate account information (name, email, professional role)
  • You are responsible for maintaining the security of your account credentials
  • You must not share account credentials with others

Acceptable Use

4.1 Permitted Uses

  • Professional legal research and analysis
  • Document review and analysis
  • Case preparation and strategy development
  • Educational and training purposes

4.2 Prohibited Uses

  • Using the Service for illegal activities
  • Attempting to circumvent security measures, rate limits, or access controls
  • Sharing account credentials with unauthorized individuals
  • Uploading malicious code, malware, or harmful content
  • Using the Service to harass, threaten, or harm others
  • Attempting to access data belonging to other users or firms
  • Violating applicable laws, regulations, or professional ethical standards
  • Scraping, reverse engineering, or automated extraction of Service data or functionality

4.3 File Upload Restrictions

  • Accepted file types: PDF, DOCX, DOC, TXT, RTF
  • Maximum file size: 50 MB per file
  • Files are validated for type, MIME integrity, and scanned for malware signatures before processing

Atticus Does Not Provide Legal Advice

  • No attorney-client relationship is created through use of the Service
  • All AI-generated content is for informational purposes only
  • Professional judgment and independent verification are required
  • Users should consult qualified legal counsel for legal advice

AI Limitations

  • AI systems may generate incorrect, incomplete, or outdated information
  • All AI outputs should be independently verified against authoritative sources
  • The causes of AI errors cannot always be traced or explained
  • Legal professionals must review all AI-generated content before relying on it in professional practice
  • AI-generated research does not constitute a substitute for comprehensive legal research using authoritative databases

Pricing and Payment

  • Price: $75 per month per user
  • Billing: Monthly, automatically renewing
  • Payment: Processed through Stripe (PCI-DSS Level 1 compliant). Major credit and debit cards accepted.
  • Cancellation: Cancel anytime from your account settings -- no penalties or fees
  • Refunds: Prorated refunds available at Company discretion
  • Failed Payments: Service access may be suspended if payment processing fails. AI features require an active subscription.
  • Storage: Each account includes a storage allocation. Current limits are displayed in your account settings.

Stripe handles all payment processing. We do not store credit card numbers, CVVs, or full payment details on our servers. Stripe retains billing records for 7 years per tax compliance requirements.

Data Ownership and Privacy

7.1 Your Data

  • You retain full ownership of all documents you upload
  • You own the output of AI-generated analysis and research results
  • Your data is never used to train or improve AI models
  • Your data is completely isolated from other users and firms at the database level

7.2 Security and Compliance

  • HIPAA-compliant infrastructure with a signed AWS Business Associate Agreement covering EC2, RDS, S3, Bedrock, and CloudTrail
  • Encryption at rest: dual-layer (Fernet client-side + AES-256 server-side on S3; AES-256 on RDS)
  • Encryption in transit: TLS 1.2+ with strong cipher suites
  • BAA and DPA available on request for customers who handle protected health information or require formal data processing documentation

7.3 Data Retention

  • Documents and conversations are retained until you delete them
  • Audit logs are retained for 7 years per HIPAA requirements
  • Account deletion anonymizes personal information and removes all documents and conversations
  • Full retention schedule is documented in our Privacy Policy

Data Processing and AI

8.1 How Your Data Is Processed

When you use the Service, your data is processed as follows:

  • Document upload: Files are validated (type, size, MIME, malware scan), text is extracted, the file is encrypted and stored in S3, and vector embeddings are generated for search
  • AI analysis: Your query and relevant document context are sent to AWS Bedrock (Anthropic Claude) via TLS for processing. AWS does not retain your data after generating a response.
  • Web search: If enabled, general legal research queries are sent to Exa AI. Automated PII detection screens queries before transmission. Confidential client information is never sent to this service.

8.2 Subprocessors

We use third-party service providers to operate the platform. A complete and current list of subprocessors, including what data each processes and their compliance status, is maintained on our Security page. We will notify customers of material subprocessor changes at least 30 days in advance.

8.3 Web Search Acknowledgment

The web search feature is powered by Exa AI, a third-party service that is not covered by a BAA. Before enabling web search, you must accept a usage agreement within the platform. The platform implements automated PII detection to block queries containing personal information, but you bear ultimate responsibility for the queries you submit. Do not include confidential client information, protected health information, or personally identifiable data in web search queries.

Service Availability

  • Uptime: 99.9% target through AWS infrastructure with automated health checks
  • Maintenance: Scheduled maintenance with advance notice when possible
  • AI availability: The platform includes a multi-tier AI model fallback system to maintain service continuity if the primary model is unavailable
  • Support: Email support at support@atticus-ai.com, response within 24 business hours

Intellectual Property

  • Starboard Labs LLC owns all rights to the Atticus platform, including its software, design, and branding
  • You receive a limited, non-exclusive, non-transferable license to use the Service during your active subscription
  • You retain all rights to your uploaded documents, input content, and any work product you create using the Service
  • We claim no ownership interest in your content or AI-generated outputs

Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

  • We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • We do not guarantee the accuracy, completeness, or currency of AI-generated outputs
  • We are not liable for professional decisions made based on AI-generated content
  • Users assume full responsibility for professional judgment and independent verification of all AI outputs

Our aggregate liability for any and all claims arising under these Terms is limited to the total amount you paid to us in the 12 months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Starboard Labs LLC from claims, damages, losses, and expenses arising from:

  • Your use or misuse of the Service or violation of these Terms
  • Violation of applicable laws, regulations, or professional ethical standards
  • Infringement of third-party rights through content you upload or create
  • Professional malpractice or negligence in your use of AI-generated content

Termination

13.1 By You

  • You may cancel your subscription at any time from your account settings
  • You may request full account deletion by contacting support@atticus-ai.com
  • We recommend exporting any data you wish to retain before cancellation

13.2 By Us

  • We may suspend or terminate accounts for material violations of these Terms
  • We may suspend access for failed payment processing
  • We will provide notice before termination when reasonably possible

13.3 Effect of Termination

  • Access to the Service ceases upon termination
  • Your data is handled per our retention policy in the Privacy Policy
  • Audit logs are retained for 7 years per HIPAA requirements regardless of account status

Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Florida, without regard to conflict of laws provisions
  • Jurisdiction: Any legal proceedings shall be brought in the state or federal courts located in Florida
  • Informal Resolution: The parties agree to attempt good faith informal resolution for at least 30 days before initiating formal proceedings

Changes to Terms

We may update these Terms to reflect changes in the Service, our practices, or legal requirements. We will notify users of material changes via email at least 30 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the effective date.

General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and any executed BAA or DPA, constitute the complete agreement between you and Starboard Labs LLC
  • Severability: If any provision is held unenforceable, the remaining provisions continue in full force
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Waiver: Failure to enforce any provision does not waive the right to future enforcement
  • Force Majeure: Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control
